The Serious Tracking of Americans Begins

By Robert Wenzel

They have passed the health bill, they have passed the financial regulations bill and they have snuck stuff into the stimulus package bills. They are going to track your money and your body. Here's the first few things they are doing. This is step one. It will only get worse from here.

According numismaster.com:

...the Health Care Bill mandates, according to Numismaster.com, Starting on January 1st in 2012, S federal law will require coin and bullion dealers to report to the Internal Revenue Service all gold and silver coin purchases and sales greater than $600.
No that is not an error, they tacked the gold coin tracking regulations into the health bill. They are just tacking stuff on wherever they can.

As for your body, you will be required to have an "electronic health record", by 2014. They snuck this into one of the "stimulus" bills. The electronic record will include an obesity rating. The information will be required to be on a "national exchange" with only secure access (Hah!). Why the F does your obesity rating have to be on a national exchange? This is a tip off to how micro-managed they are going to attempt to run your life.

Keep in mind that the health bill and financial "reform" bill are thousands of pages, with much of the details left up to the new agencies to fill in. Obama is appointing major league interventionists to head these agencies. They are completely clueless as to how an economy works. Their regs will be over the top. It will stifle America in so many ways, it is difficult to imagine. I was in East Berlin the year before the Wall came down. I saw what constant monitoring and micro-management did to people. It is not pretty. The gray, the drab, the despair was everywhere. When you can only take orders and wait for approvals and are constantly watched, it saps the life out of you. America is going to be changing and the government is going to try and watch you and monitor your vitals, as if you were a lab rat, as it does the changing.

It is not going to be pretty.

(Thanks to John Perez for the gold coin info.)

  1. Two points -

    - this is related to the 1099 reporting on all transactions of $600 or more. There are already bills drafted to repeal this ridiculous piece of legislation.

    - even if it is not repealed, this law is so draconian, that many will simply not comply.

As a result of the 1970 Bank Secrecy Act (BSA), at least for most customers, your bank is required to fill out a CTR (Currency Transaction Report)if you have a cash transaction in excess of $10,000 in a given 24-hour period. A Suspicious Action Report(SAR) may be filed if a teller or other bank employee believes that you are "structuring" (i.e. making several smaller transactions exceeding $10K in order to not have to fill out a CTR).

I would expect that in the interest of "fighting terrorism" or "combating drug trafficking and money laundering", bullion merchants will be required to adopt the same measures with respect to coin sales.

  8. Oboma wants another tracking form brought into law starting Jan 1st 2011. The law requires armed guards sitting on the white house roof to count how many cars drive by with the drivers of said vehicles giving the flying finger of GO FUCK YOURSELF to our fine man in the white house. Americans are tired of being regulated NOW!!

BTW, does anybody think having this BMI measure on a national database is just the regular nanny-state stuff, or is there a cui bono here? Think of all of the insurance fees that will be billed by all of the clinics who will get to to weigh and measure the height of 300 million people. Not chump change.

    You want an argument? Okay:

Federal law protects the privacy of your health records. If an insurance company wants them, you must provide consent. They can require consent now, and it requires the extra steps of them getting the form from you, and then sending a copy to your physician, and then waiting for a reply. If the records were available electronically they could just access them, saving money on overhead, which in a competitive marketplace would translate into lower rates. Even if a person has no medical records, the company still might require a physical, which would cost even more. There's really nothing that they could learn with electronic records that they can't learn now in a costlier and less efficient manner.

Also, the health care reform that has been signed into law will prevent discrimination on the basis of pre-existing conditions. An unfavorable BMI, AKA obesity, falls into that category, making it a non-issue. And if they did charge higher premiums on the basis of BMI, violating the law purposefully, an easy statistical analysis checking for correlation between BMI and premiums would uncover it. It would be really easy to perform that analysis because the data would all be electronic.

    ReplyDelete
  21. "Federal law protects the privacy of your health records."

    You're joking, right? hahahahahaha

I would highly recommend you go sit down with someone who actually lived through the hell of communism because this kind of thing is what they do in a communist country.

Everything is "protected by the law"....except of course the laws don't apply to those wielding the power, only those under the boot heel. Meticulous records are always kept of individual citizens in oppressive police states -- not in free societies. And it's usually done at gunpoint. I'm not sure how that will work in a formerly free country where a large percentage of the people are very well armed.

Yes, this information is protected by the government until the next "emergency" requires the government to do something "for everyone's "security", like round up all the Japanese Americans like FDR did. That's why they have you fill out that information on the census form and collect it on your medical records.

    No thanks.

  25. Obese people and smokers are among the reasons insurance is so expensive here, along with the totally disproportionate salaries by doctors and health care workers relative to other first world nations. Penalizing people who are taking advantage of health care because of personal decisions they have made (extreme overeating, smoking, drug use) would be a good thing. As a healthy person of normal size and upright habit, I'm deeply offended by my money subsidizing fat bastards with no self-control.

As far as the costs of weighing people at clinics - have you ever had a general exam? A normal exam includes updating height/weight measurements.

As far as the bullion registration - it's a typical governmental knee-jerk reaction to assholes circumventing existing law. If people, perhaps like you, weren't trying to get around banking law through bullion exchange, it wouldn't have even been proposed. Instead of shouting ridiculous conspiracy theories or spouting right-wing talking points from your talk-show overlords, why not promote self-regulation of the gold industry to discourage breaking existing law?

I have to take exception to this. Lower costs to the providers and manufacturers rarely result in lower costs to consumers. Higher executive compensation and increased upper level employee benefits packages, yes, lower consumer costs, no.

    ReplyDelete
  29. Indeed. You cant get any sort of medical office visit without having your height and weight checked and recorded into that doctor or hospitals computer. Then all of that information is sent to your health insurer. The only way you wouldnt already have an 'electronic health record' is if you pay in cash and use a pseudonym at a clinic that doesnt check ID.

My HMO already allows me to carry my health record on an encrypted flash drive. Pretty nice to have if you travel or have serious medical issues and may need immediate attention.

As far as tracking formerly anonymous purchases of 'invisible' assets like gold, is it the general consensus that its a good idea to have wealthy people hiding their money in gold so they look poor and can get you to pay for their health care, while you as an honest and middle class (or better) appearing person pays their bills?

    Yeah, I didnt think so.

  35. Yeah, lowering costs does not equal lowering fees. There is no incentive for health care corporations, or even the average doctor to lower their fee, no matter how less expensive their costs go. For that you would need the good standard all American/Capitalist idea of competition.

Like competition from a government health care insurance company that is mandated to lower costs.

  40. Actually the electronic health record is a great idea. As an ER nurse I've seen many patients come in and are unable to give an adequate medical history. We actually lost a patient because he was unable to provide his medical history and he had never been to our hospital. He had multiple medical problems and allergies. Unfortunately we didn't know this and treated him as we do many others in his condition. If we only had access to his information from his local hospital or Md he would be alive today.

Imagine if you were on vacation and in an accident. Wouldn't you want the treating doctor to have all the necessary information to save you?

And really, don't be too concerned about the gov't tracking you. I mean look at them. They can't run anything properly. Do you really think tracking ordinary citizens would be at the top of their list? And if so , do you think they'd actually be able to do it without mucking it up?

  42. The elite's government FEARS you!!!!!!

Their fear is manifested in the laws they pass. Here is a law banning what MANY of the Founders wrote is a RIGHT of citizens when a government no longer represents them:

Section 2385. Advocating overthrow of Government

Whoever knowingly or willfully advocates, abets, advises,
o teaches the duty, necessity, desirability, or propriety of
overthrowing or destroying the government of the United States or
the government of any state, territory, district or possession
thereof, or the government of any political subdivision therein, by
force or violence, or by the assassination of any officer of
any such government; or Whoever, with intent to cause the overthrow or
destruction of any such government, prints, publishes, edits, issues,
circulates, sells, distributes, or publicly displays any written or
printed matter advocating, advising, or teaching the duty, necessity,
desirability, or propriety of overthrowing or destroying any
government in the United States by force or violence, or attempts
to do so; or Whoever organizes or helps or attempts to organize any society,
group, or assembly of persons who teach, advocate, or encourage the
overthrow or destruction of any such government by force or violence; or becomes or is a member of, or affiliates with, any such society, group, or assembly of persons, knowing the
    purposes thereof -

Shall be fined under this title or imprisoned not more than
twenty years, or both, and shall be ineligible for employment by
the United States or any department or agency thereof, for the five
    years next following his conviction.

If two or more persons conspire to commit any offense named in this
section, each shall be fined under this title or imprisoned not more than twenty
years, or both, and shall be ineligible for employment by the United States or any
department or agency thereof, for the five years next following his conviction.

As used in this section, the terms ''organizes'' and ''organize'', with respect to any society, group, or assembly of persons, include the recruiting of new members, the forming of new units, and the regrouping or expansion of existing clubs, classes,
and other units of such society, group, or assembly of persons.

Corporate America is becoming increasingly more powerful and
influential. Yet, according to the government of for and by the elites YOU,
a citizen, have to accept whatever the government does with NO recourse other than voting...... and there is sufficient proof that shows to me voting is worthless since the entrenched power structure ensures that the emplaced elite class can not be removed.

The Founders specifically wrote of the people's right to abolish a government when it no longer represents them.

    Tyranny is upon is!!!

  45. Wait... Not to try to be a voice of calm, non-partisan voice of reason here, but does anyone have a link (thomas.gov) to the section of any health care bill that addresses coin-related dealings at all?

All I see in the threads above are links to a long-on-the-books regulation for 1099 misc income of amounts over $600 that need to be reported for taxing. Which has been that way for decades.

Was there some "collector sale" tax loophole that was closed? (eg: if you called the income "collectables" could you avoid paying taxes on it?)

    ReplyDelete
  46. Found "it." So here it is, a clarification of IRS 1099 misc income reporting to include collector sales income as well as contractor income in amounts over $600. Nothing specifically to do with gold or coinage.

It just looks to me like a (not entirely unreasonable) effort to have professional ebayers pay income taxes like the rest of us. (eg: collector sales income isn't any different from contract handman work income)

I guess the conspiracy theory is in the eye of the beholder, and everyone goes a little chicken-little, but man, some of the voices on this forum ... too much Fox News I guess.

"Section 9006 of the Patient Protection and Affordable Care Act (Public Law 111-148,)turns 1099 forms into reporting forms not only for independent contractor’s income – what they have long been used for – but also to show sales, gains and losses on purchases and sales of goods as part of a trade or business."

  47. There's no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren't enough criminals, one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What's there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced nor objectively interpreted - and you create a nation of law-breakers - and then you cash in on guilt. Now, that's the system, Mr. Rearden, that's the game, and once you understand it, you'll be much easier to deal with.

  51. The electronic health record is actually a good thing. It ensures that hospitals can get your data instantly and accurately, reducing both delays and screwups when you're in the ER, where the minute that saves could very well save your life. The obesity rating actually is an important statistic, as majorly overweight people are more likely to have heart attacks when given particular drugs. I just hope it's not BMI-based, as that's a terrible way of measuring that. (According to BMI charts, bodybuilders are morbidly obese, and small frame chubby guys are perfectly fine.)

Obviously, the key is to make sure that ONLY emergency personnel can get a copy of your record without your express permission, and hopefully they were smart enough to do that. If not, then yes, it becomes more of a concern - albeit one that can be addressed with an add-on law if necessary.

So... it's definitely something to keep an eye on, and to be ready to demand changes in if they screw it up, but it's not nearly as bad as this article makes it sound.

The gold thing on the other hand, is pure BS. Whether you put your money in the bank or into precious metals is none of their business.

  55. Wow. You must be terrified. I, on the other hand, knowing that this is all just fear-based overreaction, will live comfortably in the knowledge that healthcare in this country will be marginally more accessible and fluid.

The government SHOULD keep track of how fat our country's gluttonous, lazy masses are getting; it's a public health issue. As for piggybacking the bullion purchase tracking on the health care bill, that's been the trend in government for the last 40 years. It's pretty vile, and every single politician is guilty of doing it. Rather than just blaming Obama for your fear of what your government is doing, realize that it's ALL elected officials who are doing this, Democrats and Republicans alike.

When the Republicans were in charge, this same kind of crap happened left and right, just in other forms. For example, rather than tracking our bullion purchases, the Republican controlled government allowed to be implemented the TSA, one of the most horribly personally invasive, useless, and nonsensical agencies ever created. They also started tracking our travels much more intensely, and setup unauthorized wiretaps on American citizens.

This Big Brother stuff isn't one party or the other. (They're the same party anyway...) Our culture has become so xenophobic, so self-absorbed, and so falsely righteous that Americans actually WANT this kind of surveillance. Well, so long as it surveils 'them' and not 'me.' His entire administration are admitted Marxists. Everyone he admits to admire are Marxists. His father was a Marxist. He went to a Marxist school. He is even beyond a socialist. I think he's a downright communist. To be socialist would be better than the crap Barry boy has rammed down our throats. At least it would be handing out goodies while the country goes bankrupt. His model is he'll just take everything you've got to use as he pleases-much more like communism.

It's dangerous to have a brain and/or pay attention these days. History could repeat, and the legislation is there to make it happen. I'll stay anonymous, thanks.

  60. "Wow. You must be terrified. I, on the other hand, knowing that this is all just fear-based overreaction, will live comfortably in the knowledge that healthcare in this country will be marginally more accessible and fluid. "

Fear based overreaction that they're going after gold and silder buyers just when buying gold and silver is the most crucial it's been in some time? Was it a fear-based overreaction when people hid their gold from Roosevelt who was forcing people to "turn in their gold" for pennies on the dollar so that the Federal Reserve could sell it off at market value?

Healthcare will be more accessable. . . yeah just like a firing squad makes death more accessable. I guess you missed the part that people would be forced to purchase health care or suffer fines or jail time. I guess you also forgot that masses of jobs will be lost as this takes effect when employers have to choose between YOUR JOB and complying with the new mandates. At least you'll have healthcare at gunpoint when you're dying in a gutter. Horray!

The government should not do any such thing. There is no such thing as public health. That's a made up leftist term that has no real meaning. Since when is one's health an issue for anyone other than themselves? It's not. It's none of the government's business what I do with myself. Our culture has become so xenophobic, so self-absorbed, and so falsely righteous that Americans actually WANT this kind of surveillance. Well, so long as it surveils 'them' and not 'me.' Americans are nothing if not hypocrites. And also really, really fat."

Americans don't want this kind of surveillence. That's a cop out. It's being forced on us. Every poll from every unbiased respected polling agency shows that citizen anger at government is at the highest it's ever been. The approval ratings of almost anyone in public office plummet to new lows more and more every year. The political class want this kind of surveillence (mostly because they're paranoid about this anger directed at them). The people want the government to mind it's own busines and stop trying to micro manage our lives and rob us of all of our property.

There is not just the option of empowering your "group" and enslaving all the others. There is another option: respect individual rights of EVERYONE as an INDIVIDUAL. That way, everyone can live their life how they see fit without outside interference. That doesn't fit into the collectivist Democrat or Republican models. Those models are dying. Good riddance. I want freedom. regardless of who's in office.

  62. "BTW, does anybody think having this BMI measure on a national database is just the regular nanny-state stuff, or is there a cui bono here? Think of all of the insurance fees that will be billed by all of the clinics who will get to to weigh and measure the height of 300 million people. Not chump change"

It wouldn't be a surprise. The State of Alabama already charges state employees who smoke or are overweight a higher premium on their group health insurance.

  63. For the people that don't beleive this stuff is happening? You want to go back into history where The North and South were fighting and the South thought that blacks would never be "humans" much less have "rights"...People that thought Hitler was just a man who had a lot to say and his ideas would blow over...To people that thought no one would ever make it to the moon...people who thought that blacks would always be segregated...THat a black (Muslim) man would be president "when pigs fly"...
This crap is happening folks, whether we want it to or not! Our "wonderful" nation and it's leaders and group of polititians are doing all kinds of things we have NO idea about, under our noses and you know what? no matter how much we scream, disagree, or whatever, and as much "control" we have in our right to vote, we can't do anything about it. Congress/President/Cabinet is gonna do what it wants to do..even if it means making taxpayers pay for it! ...And to you, Jefferey Gates, with your comment- (If that REALLY IS your name, you ass wipe!) My name is Jeanne, I tried to leave my name, but I have to have a URL, I don't have one, Ass fucker!

  65. You can refuse to be weighed in the doctors office. You can find a new doctor if your wishes are not honored. You can refuse to 1099 your electric company as a small business. You can refuse to spend more than $599 for anything.

  66. Since fatasses end up using healthcare far more than healthy people, why shouldn't BMI ratings be part of their records? Crank up the insurance on the people that use the system the most. Don't want to pay high insurance premiums? TAKE CARE OF YOUR BODY.

Scandinavian countries have excellent socialized medicine, but it doesn't come at a huge cost to taxpayers because the people there have more sense than the average American. Put the cheeseburger down, fatty, and get on the bike.

  72. The author of this article should provide more facts and less political diarrhea about how Democrats want to turn America into a drab communist country. While it may score you brownie points with the Tea Bag and rightwing extremist crowd it only makes you look idiotic to everyone else.

  74. I agree ole gal. Never give up! I've been in that mode for 9 years, trying to survive divorce in Massachuesetts where lawyers routinely get the money and families are destroyed by the SJC, DOR, and unscrupulous individuals who are enabled by the policies and practices of these government bodies which I have found woefully inefficient. Throwing more of our money (i.e. TAXES) at it to try to identify and control everything will depress our freedoms and abilities to focus on the pursuit of happiness. All the paperwork and/or computer work hell is ungodly and created by the legal industry (i.e. Lawyers/judges) to our detriment! This goes back a while too, about 45 years and further when thinking about the Federal reserve act (not told about) and Nelson Rockefella's drive to tax the great people of New York to name just a couple examples.

  78. To the one posting about smoking, smokers cost less to the healthcare system, several study numbers back this up. The reason is smokers actually die of something. The healthy will have several partial failures of various bodily systems taking up to two decades to eventually die.

Yes, the gold reporting is in case an FDR seizure is needed because they can't run a treasury or central bank.

Yes, they will use your information medical or otherwise for any damn thing they see fit. They already do this in Ohio, they sell batches of people's information for money, names, ss, everything. Not only that but they grab whoevers information they want as identities for undercover operations, don't be suprised if Frankie the enforcer shows up at your door thinking you ratted them out.

  79. WHEN WILL THE PUBLIC REALIZE THAT THE ONLY WAY TO CORRECT OUR( AMERICAN CITIZENS) PROBLEMS IS TO MANY POLITICIANS AN ENDANGERED SPECIES.WE NEED LAWS TO CURB THEIR ARROGANCE. IF THEY DO MORE DAMAGE THAN GOOD FROM THEIR ACTIONS THEY SHOULD LOOSE ALL THEIR INVESTMENTS, THEIR HOUSE, AND MEDICAL AS WELL + NO PENSIONS. THEN MAYBE THEY WOULD DO THE JOB THEY WERE VOTED IN FOR!!!!!!!

  80. YES, we as citizens have the right to PROTEST and NOT COMPLY WITH THE FEDS WHEN THEY CLEARLY ARE TRASHING OUR CONSITUTIONAL RIGHTS TO PRIVACY.
ITS TIME WE UNDERSTAND THAT NOW IS THE TIME TO DECLARE OURSELVES AND STAND UP AGAINST THEM IN EVERY REASONABLE WAY POSSIBLE. IF THEY CONTINUE TO OVERSTEP OUR RIGHTS, THEN WE WILL HAVE THE HARD DECISION OF OUTRIGHT DEFIANCE AND FROM THERE... IT GOES TO THE STREETS.

  81. The economic illiteracy expressed in most of the comments herein is very saddening. Perhaps, one of the benefits of the Internet is we can see how dumbed down America has become.
For one stream of non-thinking, people with bad habbits pay MORE in their insurance premiums. With the Marxist care, everyone will pay for smokers, except one day, as in England, when money runs out, a guy with a broken leg (this is a real case) will be denied corrective surgery because he smoked.

  82. It is well that you wag your tongues now. When I get into the street to once again honor the oath I took to defend the Constitution of the United States, you who stand between me and my target, wagging your tongues at one another with your endless, meaningless babble, will be obstructions to my line of fire. But not for long. And when it is all over, I will again raise Old Glory above my home (or foxhole, or whatever is left). And I will continue to live (if I do so . . .) a FREE man in the United States of America, as defined by our Constitution.

  85. Read "Gods's War on Terrorism, by Walid Shoebat, If you still believe Obama is not a muslim, You would have to be blind. Once you are a muslim you can not convert, its not allowed, and if you do, (like the author of this book did) Then they have to go in to hiding, because the muslims will kill you for converting. You would not be in the middle east bowing before muslim kings, as Obama did! You will not be able to put this book down! It gives the real end times scenereo, and it's not decades away. It is here. Get your ark ready!

  86. Someone above said Obama was a dirty muslim I believe the slur was. WEll, he must be if he has 32 dual Israeli citizens working for him at the White House in key positions, not including the dept of defense and we know he is also a dual Israeli citizen on his mothers side of the family, so that is pretty orwellean if you ask me, a muslim President trying to get shira law implemented using 32 dual Israeli citizens... yup pretty orwellean indeed.

  88. If you elect more Dems.Your problems will only get worst. They wish to have every penny that you make go to help some people who have no desire to work. However I recent the fact that most Dems, always wish to take care of unions, and they say the poor. They have managed to increase taxes every place they can locally.
They always say we are not going to raise taxes on the middle class. This is just another lie.Townships and City Goverments continue to raise taxes.Teachers,Trash collectors and office workers that work for us don't care that we do not get pay increases. They want theirs.9&10% for three year contracts. They now average more per year then regular working class people and with great retirement packages.
Letting these people unionize was the worst thing that ever happen.I say next time let them stike.Hire new people to take their place.Vote every liberal out of office.Stop the spending.
As for the poorI have been by social service locations.I know for a fact they will give food cards and housing help to drug addicted people.
These same people have children they cannot care for and they end up dropping the kids off and Ma and Pa's home. Why can people continue to populate the world when they cannot take care of themselves. We poor bastards keep giving more of our hard earned cash to the government. They just take it and give it to the criminals and the so called under privileged.Oh by the way the criminals get Social services too. This is to supplement them between crimes.Thats it
I'm just tired of it all.It has gotten so much worst.I never thought it could get this bad.I'm only 59 yeas old and thought I had seen it all.Until lately.God Help us all.Vote them out.
