Judge Napolitano on SC’s Anti Obamacare Bill: “If enough states do this, it will gut Obamacare”

Judge Andrew Napolitano said South Carolina has the Constitutional right to pass a bill that would essentially nullify or eliminate Obamacare. The bill, entitled “South Carolina Freedom of Health Care Protection Act,” was voted on and passed by a 65-34 vote in the state House of Representatives last April.

  3. This isn't going to "gut" Obamacare. This merely means the state is refusing federal dollars and the strings attached to those dollars. The citizens of the state still have to comply with the federal mandate which is what most people are upset about. Health insurance companies selling policies in that state also have to comply with Obamacare.

    South Carolina is not nullifying a federal law. South Carolina is refusing to comply with a provision that was ruled unconstitutional by the Supreme Court. Due to the Supreme Court provision, Medicaid expansion is voluntary.
