One of Greenwald's points is that the present release includes actual lists of people who have had their private information collected by the NSA, without any probable cause. Based on the article such specific information was lacking in 2006.
I do not have any confidence that the Supreme Court would find mass collection of phone/e-mail records to be unconstitutional, though. The only thing that can stop such practices is widespread public awareness of the dangers of letting a government keep records of all private communications forever (or for any length of time). I'm sure the major media will do everything they can to prevent such public awareness from growing.
Hopefully there is something else in these releases since this information came out in 2006.
