Sirgiorgio Clardy, 26, is an Oregon pimp who this last July was declared a dangerous offender and sentenced to 100 years in prison after using his Nike brand Jordan’s to stomp the face of a man for not paying one of his prostitutes. Now, he is suing Nike to the tune of $100 million for failing to provide a warning label that using their shoes as a weapon could cause harm to the user. "Do (sic) to the fact that these defendants named in this Tort claim failed to warn of risk or to provide an adequate warning or instruction it has caused personal injury in the likes of mental suffering," says Clardy, who also says he has tried to kill himself as a result.

this sounds like it was filed in a state court, but either way the filer should be fined for bringing a frivolous lawsuit and wasting the courts time. the attorney should be investigated on ethics charges as well
ReplyDeletesounds like it was pro se, anyone can sure for anything - dosn;t mean they have stated a claim. A prisoner with years of free time can file anything. Very rare for a court to sanction. Do you want prisoners to be fearful of trying to assert legal claims?

ReplyDeleteThat eldery woman recieved 3rd degree burns and asked for nothing more than enough money to cover her medical costs.They denied her request and then she brought in the lawyers. This reminds you of that?

DeleteCheck out the wiki on the McDonald's case. It happened in 1994. At the time, McDonalds required its franchisees to hold coffee at 180–190 °F (82–88 °C). At 190 °F (88 °C), the coffee would cause a third-degree burn in two to seven seconds. Normally, coffee is kept no hotter than 140 degrees.
