The Supreme Court is allowing California to continue enforcing a law that bans the sale of foie gras.
The justices have rejected a challenge to the law from producers.
The California law bars state farmers from force-feeding birds with a tube, the way foie gras is made.
The law also bans the sale of foie gras in California.
It's a stupid law, but it doesn't seem to violate the Constitution. The law falls under the 10th Ammendment, and doesn't violate any of the restrictions on what states can do.
ReplyDeleteBTW, I am a Rothbardian, but the Supreme Court is tasked with measuring laws against the Constitution, not "The Ethics of Liberty."
